Tragically, the fires on August 8 resulted in the loss of at least 115 lives and left an undisclosed number of individuals missing, marking the deadliest fire incident in the United States in over a century.

Hawaii Electric responded with a statement expressing its disappointment with Maui County’s decision to pursue litigation while the investigation is still ongoing.

The lawsuit contends that the destruction could have been averted and that the utility had a responsibility to maintain and repair its electric transmission lines, utility poles, and related equipment. It also argues that the utility should have appropriately managed vegetation to prevent contact with overhead power lines and equipment.

The lawsuit asserts that the losses could have been easily prevented if Hawaiian Electric had implemented a similar power shutdown plan.

The drought county’s legal pursuit seeks compensation for the damage inflicted on public property and resources in Lahaina and neighboring Kula.

Recent incidents have seen other utilities held accountable for destructive fires. In Oregon, a jury found PacifiCorp liable for causing devastating fires in 2020, resulting in a significant financial settlement. Similarly, Pacific Gas & Electric faced legal repercussions and declared bankruptcy after their equipment sparked a fatal fire in California in 2018, causing widespread devastation.
